Terms & ConditionsPayment and Billing
All payments must be made payable to Beatmill in US dollars. All services require a 50% nonrefundable
deposit before the commencement of services. The balance is due immediately upon
completion of services. The final product will not be provided to the client until the balance of
the account has been paid. Customer will hear and agree to final product before delivery.
Client will be responsible for any all of media storage fees over $5.00 USD. Therefore, if client chooses to have their final product delivered in alternative media other than cd-rom (ie: dat, 2-
inch tape, etc), and the cost of the media exceeds $5.00 USD, the client agrees to pay the cost of the chosen media.
Prices are subject to change at anytime without notice.
Returned checks will incur a $25 check-return fee.
Product Delivery
Final mixes will be delivered in both a 2-track stereo mix, and multi-tracked wav. Files with all effects, edits, and changes made during the mix via cd-rom unless otherwise specified.
Final masters will be delivered in 2-track stereo mix via cd-rom unless otherwise specified.
Beatmill will provide an estimated delivery time to the customer after evaluation of the provided material, and will make every effort to provide the client with a final product in a timely and
efficient manner. However, the client acknowledges that this will be only an estimate of time and additional time may be needed to achieve premium results.
Warranty
Beatmill guarantees product satisfaction through our client approval process. Each song that is mixed and or mastered will be approved by the client before final product delivery.
The customer will receive 2 free revisions. Additional revisions will incur additional fees that will be discussed with the client before the commencement of work.
The client understands that Beatmill services will be provided post production and recording. Therefore, Beatmill will be held blameless for any damaged or badly recorded, and or produced
material. Beatmill encourages all clients to review their production and recordings to ensure that they have the best possible material for submission of services.
Masters
All material including audio, source tapes, cd-roms, disc, dats, DAW sessions, etc. remain the sole exclusive property of the legal copyright owner(s).
Beatmill will make every effort to secure the client’s intellectual property. Beatmill does not accept liability for material as it relates to damage, loss due to fire, flooding, looting, thefts,
negligence, or acts of God while the client’s material is in the possession of Beatmill. Beatmill encourages all clients to make additional copies (backups) of all products they send to Beatmill.
Beatmill encourages all Clients to copyright all material before submitting for it for services.
Infringement
Client agrees the he/she holds the copyright or has permission from the copyright owner(s) for all material submitted to be mixed or mastered by Beatmill. Beatmill shall in no way be
responsible for any illegal use of audio material used within the Audio products submitted to Beatmill by the Client. Client assumes responsibility for any and all legal fees incurred in the
event that legal action is taken against either Client or Beatmill related to the illegal use of copyright material.
Client holds, at the time of execution of this Agreement and throughout its entire term, without limitation or condition, all rights in and to the Audio products submitted to Beatmill and listed, or is specifically authorized by the holder of such rights in and to these Audio Products to grant the foregoing rights in and to such works under this Agreement.
Client is authorized to engage Beatmill for the purposes of this Agreement.
Client shall not require, obligate or seek to impose any duty on Beatmill to pay or to provide for payment to any contributing artist, producer, composer, performer, lyricist, licensee, sublicensee, or any other party who contributed to the submitted material.
